THIS cause came up on a writ of error to the sixth cir cuit court of the United States for the district of Georgia. It was tried in Milledgeville at May term 1827. In the course of the trial, a number of questions were raised, on some of which, the judges, being divided in opinion, refused to give the jury the instruction prayed by the plaintiff; and a verdict and judgment were rendered for the defendants. The present writ of error was brought to reverse this judgment. In the court below, the plaintiff, to sustain his case, gave in evidence a grant from the state of Georgia to Bazil Jones, for 7160 acres of land, in Franklin county, on the waters of the south fork of the Oconee river, since called the Appalachie, bearing date the 24th day of May 1787, and deduced his title to the disputed premises regularly from the grantee.
